Drafting Enforceable Federal And Military Retirement Orders In A Divorce

Standard Qualified Domestic Relations Orders (QDROs) and state-level Qualified Illinois Domestic Relations Orders (QILDROs) cannot divide federal civil service pensions, Thrift Savings Plan (TSP) accounts or military retired pay.

Dividing these assets requires specific court orders, exact regulatory phrasing and strict compliance with agency filing deadlines. At the Law Offices of Anne Schmidt, LLC, drawing on an extensive background in ERISA and employee benefits law, attorney Anne Prenner Schmidt works directly with counsel nationwide to resolve these technical drafting hurdles before agreements are finalized.

FERS And CSRS Civil Service Annuities

Pensions under the Federal Employees Retirement System (FERS) or the Civil Service Retirement System (CSRS) require a Court Order Acceptable for Processing (COAP) under 5 CFR Part 838.

Generic settlement agreements often fail to specify how to handle cost-of-living adjustments and survivor annuities – the exact issues a COAP is designed to solve. If an order remains silent regarding survivor benefits, the former spouse has no survivor annuity, and payments stop permanently upon the retiree’s death.

The order should also state who bears the cost of this protection. Unless the order says otherwise, the Office of Personnel Management (OPM) computes the former spouse’s share from the net annuity, which is reduced not only by the survivor annuity cost but also by health and life insurance premiums and tax withholding. Decrees that simply order a “50/50 split” without the terms OPM requires often lead to rejection or unintended results. Anne drafts these orders to OPM’s requirements from the start.

Thrift Savings Plan (TSP) Accounts

The TSP is a defined contribution plan for federal workers. Court orders dividing TSP accounts are governed by 5 U.S.C. § 8435(c) and 5 CFR Part 1653. Dividing this asset requires a Retirement Benefits Court Order (RBCO), not a QDRO or QILDRO.

A valid TSP order must state whether the award is a set dollar amount or a percentage as of a specific valuation date. The document must also clarify whether earnings and losses apply before actual distribution. The TSP will not interpret ambiguous decree language. Orders missing required regulatory terms face immediate rejection. Anne drafts TSP orders to meet the TSP’s regulatory requirements.

USFSPA Military Retired Pay

The Uniformed Services Former Spouses’ Protection Act (USFSPA), 10 U.S.C. § 1408, governs the division of military retired pay.

The 10/10 Rule For Direct Payments

To receive direct retirement payments from the Defense Finance and Accounting Service (DFAS), the marriage must overlap with at least 10 years of creditable military service. This rule affects only who sends the monthly check – DFAS or the service member. It does not limit a judge’s power to divide the pension.

The Frozen Benefit Rule

For divorces finalized after December 23, 2016, federal law freezes the divisible retired pay at the service member’s high-3 pay and years of service (or retirement points, for Reserve members) as of the date of divorce, increased by retiree cost-of-living adjustments. The former spouse’s share is not calculated based on rank or service achieved at actual retirement.

Survivor Benefit Plan (SBP) Deadlines

Awarding former spouse SBP coverage requires explicit election language in the court order. The former spouse should also file a formal “deemed election” within one year of the court order, with DFAS if the member is retired or with the member’s service branch if not. Missing this strict deadline permanently forfeits survivor protection.
